OF THE STORE “MyHeroTale”
These Terms and Conditions define the rules for using the online store as well as the rules for placing and fulfilling orders.

1. Subject of Purchase The store “MyHeroTale” offers personalized products (hereinafter referred to as “Products”), in particular audiobooks, audio tales, and video files, created based on a questionnaire completed by the Customer. Products are delivered exclusively as digital content (downloadable file).
2. Ordering Process The Customer places an order using the Order Form on the website www.myherotale.co.uk or via e-mail (contact@myherotale.co.uk). Completing the personalization questionnaire is mandatory and constitutes the basis for creating the personalized Product (e.g., audiobook). After placing the order, the Customer receives a confirmation via e-mail.
3. Price and Payment The price stated in the order is a gross value (including tax) and includes the cost of digital delivery. Available payment methods: traditional bank transfer, online payments (Przelewy24, Apple Pay, Google Pay, payment card). Payment by bank transfer must be made within 5 working days of placing the order unless a different deadline has been agreed upon with the Store staff. Discount codes and vouchers can be redeemed in the Order Form, in accordance with their validity terms.
3a. Promotional Campaign: “Pay If You Find It Worthwhile” As part of the promotional campaign “Pay If You Find It Worthwhile”, the Customer fills out a personalization questionnaire, based on which an audiobook in electronic version is created. Upon completion, the Customer receives an e-mail with a link to listen to the material in the application. After listening, the Customer receives a message with a payment link. Payment is completely voluntary – the Customer may pay only if they consider that the Product has met their expectations. In the event of non-payment within 24 hours from the moment the Seller sends the notification (regardless of the contact method: e-mail, SMS, phone), access to the material is automatically blocked, and the ability to listen expires. Failure to pay does not result in any financial or legal consequences for the Customer.
4. Delivery (Delivery of Digital Content) The link to download the Product is sent to the Customer’s e-mail address indicated in the order. The shipping (delivery) time is up to 3 working days from the moment the production process is completed (receipt of the complete set of data and, in the case of prepayment, crediting of the payment). The Seller is not responsible for the non-delivery of e-mail messages resulting from causes beyond their control (e.g., anti-spam filters of the Customer’s e-mail, incorrectly provided e-mail address).
5. Personalization and Fulfillment The Product is created based on data from the questionnaire and is personalized in nature, which means it is produced individually for the Customer. The questionnaire should be completed and sent within 48 hours of placing the order. In the absence of a questionnaire, the Seller may cancel the order after prior notification to the Customer. Order fulfillment begins after receiving the completed questionnaire and payment (unless the “Pay If You Find It Worthwhile” option was selected). The Seller is not responsible for errors in the content of the Product resulting from incorrect data provided in the questionnaire by the Customer. Changing the content of the Product after fulfillment is possible for an additional fee, agreed upon individually. The fulfillment time is calculated from the moment the Seller receives the correctly completed personalization questionnaire and voice recording (if the Customer decided to add one). In the case of choosing the option “NO, RECORD IT FOR ME”, fulfillment is calculated from the moment of receiving the complete questionnaire.
5a. Sending and Processing of Graphic Materials (Photos) In the case of selected Products (e.g., video tales, personalized covers), the Customer has the option to send a photo (e.g., an image of a child) for the purpose of personalization.
- Licence and Rights: By sending a photo, the Customer declares that they hold full copyright to it and the right to use the image of the persons visible in it. The Customer grants the Seller a licence to use the photo solely for the purpose of fulfilling the order (creating a personalized Product). The Seller does not acquire rights to further distribute the photo for purposes other than the performance of the contract.
- Confidentiality: The Seller guarantees that the sent photos will not be shared publicly, published on social media, or used in the Store’s advertising materials without the separate, express consent of the Customer.
- Data Deletion: Graphic files sent by the Customer are stored on the Seller’s servers solely for the time necessary to fulfill the order and the warranty period (handling potential complaints), but no longer than 30 days from the date of Product delivery. After this period, the files are permanently and irretrievably deleted.
6. Consent to Loss of the Right of Withdrawal The Customer may consent to the commencement of order fulfillment before the expiry of the 14-day period for withdrawal from the contract. In the case of a personalized Product (digital content), the commencement of fulfillment (starting production or sending the file) means the loss of the right of withdrawal in accordance with Art. 38 par. 1 points 1 and 3 of the Consumer Rights Act. Sample consent (expressed in the Order Form): “I hereby consent to the commencement of the order fulfillment before the expiry of 14 days from the conclusion of the contract. I am aware that upon receipt of the personalized Product (digital content), I lose the right to withdraw from the contract in accordance with Art. 38 par. 1 point 3 of the Consumer Rights Act.” The Seller confirms receipt of the consent via e-mail.
7. Right of Withdrawal A Customer who is a Consumer or an Entrepreneur with Consumer rights has the right to withdraw from the contract within 14 days of concluding the contract, provided they have not expressed consent to the commencement of fulfillment (point 6) and the service has not been fully performed. The right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer’s prior express consent before the deadline to withdraw from the contract and after informing them of the loss of the right of withdrawal.
8. Complaints In the event of non-conformity of the Product with the contract (e.g., damaged file, missing content), the Customer may submit a complaint in writing (ul. Brynicy 24, 40‑358 Katowice) or via e-mail (contact@myherotale.co.uk). The Seller considers the complaint within 14 days, offering repair (e.g., re-sharing the file, correcting the recording in the case of a Seller’s error).
9. Licence for Use The Customer receives a non-exclusive, non-transferable licence to use the Product solely for their own personal use. Public sharing, reselling, or distributing the Product is prohibited. To play the Products, a device with internet access and an audio/video file player (e.g., MP3, MP4) are required.
10. Data Protection Data provided in the questionnaire is processed solely for the purpose of order fulfillment and protected in accordance with the Privacy Policy available on the Store’s website.
